1. Agreement to Terms

By accessing or using the website at digitalgrowth-lab.com or engaging our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services. These terms apply to all visitors, clients and users of Digital Growth Lab.

2. Our Services

Digital Growth Lab provides digital marketing, AI automation and web development services including but not limited to:

• Google Ads and Meta Ads campaign management
• AI chatbot, voice agent and workflow automation
• CRM setup and management (GoHighLevel, HubSpot)
• Website and mobile application development
• Social media management and content creation
• SEO and content marketing

3. Client Responsibilities

• Provide accurate and complete information when engaging our services
• Provide timely access to necessary accounts, assets and approvals
• Pay invoices within the agreed payment terms
• Ensure all content and materials provided to us do not infringe third-party rights
• Comply with the advertising policies of Google, Meta and other platforms

4. Payment Terms

Unless otherwise agreed in writing:

• Setup fees are due before work commences
• Monthly retainer fees are due on the 1st of each month
• Invoices are due within 7 days of issue
• Late payments may result in suspension of services
• Ad spend is paid directly to advertising platforms by the client and is not included in our management fees

5. Results and Performance

Digital Growth Lab does not guarantee specific results, revenue targets or advertising performance metrics. Digital marketing involves inherent variability and results depend on factors outside our control including market conditions, client industry, competition and advertising platform algorithm changes. We commit to applying best practices and industry expertise to maximise performance.

6. Intellectual Property

Upon full payment of all fees:

• Deliverables created specifically for you (websites, custom code, designs) become your property
• Pre-existing tools, frameworks, templates and methodologies remain the property of Digital Growth Lab
• You grant us permission to reference your company name and results in our portfolio and case studies unless otherwise agreed

7. Confidentiality

Both parties agree to keep confidential any proprietary information, trade secrets or sensitive business information shared during the course of our engagement. This obligation survives termination of services.

8. Termination

Either party may terminate a service agreement with 30 days written notice. Setup fees and work completed prior to termination are non-refundable. Upon termination, we will provide you with all assets and access credentials within 7 business days.

9. Limitation of Liability

To the maximum extent permitted by law, Digital Growth Lab shall not be liable for any indirect, incidental, special or consequential damages arising from our services. Our total liability shall not exceed the fees paid by you in the 3 months preceding the claim.

10. Governing Law

These Terms of Service are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

11. Changes to Terms

We reserve the right to update these Terms of Service at any time. Continued use of our website or services after changes constitutes acceptance of the new terms.
